Shape Plain Capital Elegant Black Diamond® CARDHOLDER 

AGREEMENT

This Shape Plain Capital Elegant Black Diamond® Cardholder Agreement, together with your Shape Plain Capital Elegant Black Diamond® Rates and Fees Table, Arbitration Agreement, Rewards Program Terms and credit card application (collectively, this “Agreement”) govern the use of the Shape Plain Capital Elegant Black Diamond® Credit Card (“Card”) and related credit account (“Account”). All of the separate documents governing the Account, and any future changes we may make to this Agreement, are part of this Agreement. Please read this Agreement and retain a copy for your records. You accept this Agreement, and it becomes effective, if you do not cancel your Account within 30 days after receiving a Card. You also accept this Agreement if and when you (or a person authorized by you) make a Transaction using the card. Your use of the Card is your consent to be bound by the terms of this Agreement.

 

The Card is issued by Shape Plain Capital Private Bank, pursuant to a license from Shape Plain Capital U.S.A. Shape Plain Capital Private Bank is the creditor and Card issuer. As used in this Agreement, “we,” “us,” and “our” mean Shape Plain Capital Private Bank, and any assignee of its rights. The words “you” and “your” mean all persons responsible for complying with this Agreement, including the applicant, the cardholder, any guarantor and the person to whom we address Account statements.

 

Where applicable, this Agreement supplements but does not replace the Shape Plain Capital (collectively, “Shape Plain Capital”) Customer Agreement or the Shape Plain Capital Elegant Black Diamond Agreement (collectively, “Customer Agreements”). In the event of an inconsistency between this Agreement and the Customer Agreements, this Agreement shall govern and control your use of the Shape Plain Capital Elegant Black Diamond® Credit Card and your relationship with the Bank.
