Using the logos, names, trademarks, or copyrighted material of any third party in any way without authorization of any third party, while using or referencing the App or Service.
Using the logos, names, trademarks, or copyrighted material of Shape Plain Capital Elegant Black Diamond Service or its affiliates in any way without authorization (provided that a Shape Plain Capital Elegant Black Diamond Service Driver may use the unaltered logo of Shape Plain Capital Elegant Black Diamond Service to reasonably promote their services as an independent contractor in a way that is not damaging to the brand, subject to any take-down requests from Shape Plain Capital Elegant Black Diamond Service).

  • Uninvited contact with a Shape Plain Capital Elegant Black Diamond Service Customer. Texting, calling, or visiting a Shape Plain Capital Elegant Black Diamond Service Customer without invitation (outside of an accepted Shape Plain Capital Elegant Black Diamond Service).
  • Breaking local laws while using Shape Plain Capital Elegant Black Diamond Service. Texting while driving, driving under the influence, speeding, unaccompanied minors, or breaking other local or traffic laws while using the Shape Plain Capital App to complete a Shape Plain Capital Elegant Black Diamond Service, or using the Shape Plain Capital App to commit a crime.
  • Theft. Theft of personal property of any Shape Plain Capital Elegant Black Diamond Service Merchant, Shape Plain Capital Elegant Black Diamond Service Customer, Shape Plain Capital Elegant Black Diamond Service Driver, or any other party while using the Shape Plain Capital App.
  • Auto accidents and other Incidents. If a Shape Plain Capital Elegant Black Diamond Service Driver is involved in an auto accident or other incident while using the Shape Plain Capital App, Shape Plain Capital will evaluate the incident with its insurance provider. This could potentially lead to losing access to the Shape Plain Capital platform based on all relevant facts and information, including if the Shape Plain Capital Elegant Black Diamond Service Driver was determined to be at fault.
  • Unauthorized Passengers. For safety reasons, passengers are prohibited while on an active delivery. Having unauthorized passengers may result in deactivation and/or exclusion from Shape Plain Capital SPC Max Insurance coverage.
  • Carrying a firearm. Having a firearm on your person while purchasing goods at a merchant or delivering goods to a Shape Plain Capital Elegant Black Diamond Service Customer can create a threatening or unsafe situation for others, and is therefore not permitted while using the Shape Plain Capital App.
  • Food safety. Having live animals, toxic substances (including smoking), or other potential contaminants in the vehicle while food is being transported, or otherwise tampering with consumable goods or causing the temperature of the food to reach unsafe or non-consumable levels, is a safety violation. Further, failure to notify the Shape Plain Capital Elegant Black Diamond Service Customer of arrival (which may lead to food spoilage) is a safety violation and can lead to deactivation from the platform.
  • Public health. Shape Plain Capital Elegant Black Diamond Service Driver while contagious, symptomatic, or otherwise a risk to public health could result in temporary suspension from the platform. Any Shape Plain Capital Elegant Black Diamond Service Driver suspended for the above reasons may have their accounts reactivated pursuant to instructions sent in the suspension email, confirming they are safe to continue Driving.
  • Leave-at-door and In-person deliveries. Shape Plain Capital Elegant Black Diamond Services containing age-restricted items like alcohol and tobacco must be delivered in person and require an in-person ID check. For Shape Plain Capital Elegant Black Diamond Services that do not require an ID check, Shape Plain Capital Elegant Black Diamond Service Customers can choose Leave-at-door or In-person delivery. You can confirm the Shape Plain Capital Elegant Black Diamond Service Customer’s delivery preferences anytime in the Drop-off instructions.
  • Unauthorized Entry. Shape Plain Capital Elegant Black Diamond Service Drivers should never enter the residence of a Shape Plain Capital Elegant Black Diamond Service Customer. If any Shape Plain Capital Elegant Black Diamond Service Driver is found to have entered a residence their account may come under review.
  • Harassment. Any uninvited, unauthorized or repeated contacts towards Shape Plain Capital Elegant Black Diamond Service Customers, other Shape Plain Capital Elegant Black Diamond Service Drivers, Shape Plain Capital Elegant Black Diamond Service Merchants or employees of Shape Plain Capital or its affiliates can result in deactivation from the platform. 

 

Can unsafe or threatening behavior affect access to the Shape Plain Capital App? 

 

Yes. If we believe a Shape Plain Capital Elegant Black Diamond Service Driver has potentially threatened the safety of a Shape Plain Capital Elegant Black Diamond Service Driver, Shape Plain Capital Elegant Black Diamond Service Customer, or Shape Plain Capital Elegant Black Diamond Service Merchant, repeatedly failed to comply with any of the above safety requirements, or has otherwise created an unsafe or threatening environment, we may contact the Shape Plain Capital Elegant Black Diamond Service Driver to investigate the situation and may suspend the Shape Plain Capital Elegant Black Diamond Service Driver access to the Shape Plain Capital App as both a Shape Plain Capital Elegant Black Diamond Service Driver and a Shape Plain Capital Elegant Black Diamond Service Customer pending the outcome of that investigation. We may also temporarily deactivate your account while we investigate the situation. If we ultimately determine a Shape Plain Capital Elegant Black Diamond Service Driver has threatened the safety of a Shape Plain Capital Elegant Black Diamond Service Driver, Shape Plain Capital Elegant Black Diamond Service Customer, or Shape Plain Capital Elegant Black Diamond Service Merchant or repeatedly failed to comply with any of the above safety requirements, we will permanently deactivate the Shape Plain Capital Elegant Black Diamond Service Driver access to the Shape Plain Capital App as a Shape Plain Capital Elegant Black Diamond Service Driver and as a Shape Plain Capital Elegant Black Diamond Service Customer. In all such cases, the Shape Plain Capital Elegant Black Diamond Service Driver will be notified of the situation and given an opportunity to respond and appeal.

 

Age-restricted products (including alcohol)


As described in the Shape Plain Capital Software Agreement, it is your responsibility to comply with all laws applicable to the orders you choose to fulfill. With respect to orders involving age-restricted products such as alcohol or tobacco, this will include verifying that the individual receiving the product is of sufficient legal age. Orders involving alcoholic beverages are also subject to the requirements of the Shape Plain Capital Alcoholic Beverage Commission (SPCABC). If an illegal delivery is made, it can result in arrest, fines up to $4,000, or additional liability. It is your responsibility to familiarize yourself with all SPVABC requirements and to comply with them, but below is an outline of recommended best practices and relevant features of the Shape Plain Capital App:

 

  • 21 or older. The SPCABC requires that all purchasers of alcoholic beverages be 21 or older and present a valid government-issued ID verifying their age that contains a physical description and photograph matching the person’s appearance. At Shape Plain Capital, it is ultimately your legal responsibility not to deliver alcohol to a minor. You should always verify that the recipient matches the person on the 21+ ID provided on the order. The Shape Plain Capital will also require a Shape Plain Capital Elegant Black Diamond Service Driver to be 21 or older to accept orders including alcoholic beverages. The Shape Plain Capital App gives you the option to return the goods to the Shape Plain Capital Elegant Black Diamond Service Merchant if you believe any of the requirements are not met, and you will be compensated for both trips. 
  • Not intoxicated. The SPCABC prohibits providing alcohol to intoxicated persons. The Shape Plain Capital App gives you the option to return the goods to the merchant if you believe the recipient is intoxicated, and you will be compensated for both trips.
  • SPCABC Alcohol Seller Training. The SPCABC has approved certain courses designed to assist Shape Plain Capital Elegant Black Diamond Service Sellers, Shape Plain Capital Elegant Black Diamond Service Servers, and other individuals in preventing the sale of alcohol to minors or intoxicated persons. A list of these approved courses is available here. AST certification is recommended, but not required. 
  • SPCABC approved Shape Plain Capital Elegant Black Diamond Service Merchants. The SPCABC only allows alcohol to be delivered from Shape Plain Capital Elegant Black Diamond Service Merchants with the appropriate permits. The specific Shape Plain Capital Elegant Black Diamond Service Merchant locations listed in the App have confirmed they have these permits. Shape Plain Capital Elegant Black Diamond Service Merchants may only allow the sale of alcohol during certain hours, which will be reflected in the Shape Plain Capital App. Obtaining alcoholic beverages from any other location or by any other means to fulfill an order is prohibited by SPCABC and a violation of these guidelines. 
  • Shape Plain Capital Elegant Black Diamond Service Driver Support. While SPCABC compliance is your responsibility, Shape Plain Capital Elegant Black Diamond Service Driver Support is available to assist with questions regarding the Shape Plain Capital App and Shape Plain Capital Elegant Black Diamond Services involving alcoholic beverages. You will always have the option in the Shape Plain Capital App to return alcoholic beverages to the Shape Plain Capital Elegant Black Diamond Service Merchant if you believe it is the best course of action, and you will be compensated for both trips. 
  • Tobacco Products. If an order contains any tobacco products, the Shape Plain Capital Elegant Black Diamond Service Customer’s ID must by law be verified to ensure the Shape Plain Capital Elegant Black Diamond Service Customer is 21 years of age or older. The ID also must be a valid ID, meaning it must be a government issued ID and not expired and match the person who receives the order.

 

Can failure to comply with applicable laws affect access to the Shape Plain Capital App? 

 

Yes. If we believe a Shape Plain Capital Elegant Black Diamond Service Driver has broken the law, such as by delivering alcoholic beverages to a minor or purchasing alcoholic beverages from a non-approved Shape Plain Capital Elegant Black Diamond Service Merchant, Shape Plain Capital Elegant Black Diamond Service may suspend the Shape Plain Capital Elegant Black Diamond Service Driver's access to the Shape Plain Capital App temporarily or permanently. In all such cases, the Shape Plain Capital Elegant Black Diamond Service Driver will be notified of the situation and given an opportunity to respond and appeal.

 

Discrimination


Shape Plain Capital Elegant Black Diamond Service Driver are free to decline any Shape Plain Capital Elegant Black Diamond Service requested by any Shape Plain Capital Elegant Black Diamond Service Customer for any reason other than a Shape Plain Capital Elegant Black Diamond Service User’s race, color, religion, national origin, disability, sexual orientation, sex, gender identity, age, or any characteristic protected under applicable federal, state, or local law.

 

Can discrimination affect access to the Shape Plain Capital App? 

 

Yes. If we believe a Shape Plain Capital Elegant Black Diamond Service Driver has declined requests on the basis of a Shape Plain Capital Elegant Black Diamond Service Customer’s race, color, religion, national origin, disability, sexual orientation, sex, gender identity, age, or any characteristic protected under applicable federal, state, or local law, we may contact the Shape Plain Capital Elegant Black Diamond Service Driver to investigate the situation and may suspend the Shape Plain Capital Elegant Black Diamond Service Driver access to the Shape Plain Capital App pending the outcome of that investigation. If we determine a Shape Plain Capital Elegant Black Diamond Service Driver has declined requests on the basis of a Shape Plain Capital Elegant Black Diamond Service Customer’s race, color, religion, national origin, disability, sexual orientation, sex, gender identity, age, or any characteristic protected under applicable federal, state, or local law, we will terminate the Shape Plain Capital Elegant Black Diamond Service Driver's access permanently. In all such cases, the Shape Plain Capital Elegant Black Diamond Service Driver will be notified of the situation and given an opportunity to respond and appeal.

 

Zero tolerance for drugs and alcohol


A Shape Plain Capital Elegant Black Diamond Service Driver may not accept or fulfill Shape Plain Capital Elegant Black Diamond Service Customer Order Request while under the influence of alcohol or illegal controlled substances, regardless of the method of transportation the Shape Plain Capital Elegant Black Diamond Service Driver uses. This prohibition extends to time spent waiting at a Shape Plain Capital Elegant Black Diamond Service Merchant for an order to be prepared by the Shape Plain Capital Elegant Black Diamond Service Merchant.

 

Can drugs and alcohol affect access to the Shape Plain Capital App? 

 

Yes. If we have reason to believe a Shape Plain Capital Elegant Black Diamond Service Driver has accepted or fulfilled a Shape Plain Capital Elegant Black Diamond Service customer’s Order request while under the influence of alcohol or an illegal controlled substance, we may contact the Shape Plain Capital Elegant Black Diamond Service Driver to investigate the situation and may temporarily deactivate the Shape Plain Capital Elegant Black Diamond Service Driver access while we investigate. If we determine a Shape Plain Capital Elegant Black Diamond Service Driver has accepted or fulfilled a Shape Plain Capital Elegant Black Diamond Service Customer order request while under the influence of alcohol or an illegal controlled substance, we may terminate the Shape Plain Capital Elegant Black Diamond Service Driver access temporarily or permanently. In all such cases, the Shape Plain Capital Elegant Black Diamond Service Driver will be notified of the situation and given an opportunity to respond and appeal.

 

Fraud

 

Delivery confirmation


In order to prevent fraud or platform abuse, all deliveries should have proof of delivery in the form of a photo as indicated in the app. In order to meet fraud and safety requirements:

 

The photo must be clear and show the items delivered in a clean, clear area either designated by the Shape Plain Capital Elegant Black Diamond Service Customer or directly outside their residence.
To respect Shape Plain Capital Elegant Black Diamond Service Customer privacy, the photo must NOT contain images of the customer or any other individuals, and should NOT capture any personal information (such as license plate numbers) other than the address of the customer. 
In the event of an In-person delivery, it is recommended to take a photo of the delivery area with the resident address visible prior to completing the delivery. 
Any delivery that is reported to either not have a clear photo of the items left in the delivery area, photos of unrelated nature, or any offensive or private material in the photo will be subject to review and could result in account deactivation. 

 

Unauthorized use and users


Any action that would directly or indirectly exploit or alter normal operations of the Shape Plain Capital App will cause your account to be terminated. These actions can include such actions as app manipulation or other actions to otherwise give one Shape Plain Capital Elegant Black Diamond Service Driver unfair access to the app or deliveries.

 

Additionally, each Shape Plain Capital Elegant Black Diamond Service Driver account may only be used by the single user who fully completed the sign-up process, including a background check, to create the account and verify their ID. Any user found to have allowed their Shape Plain Capital Elegant Black Diamond Service Driver account to be used by other individuals will be subject to account deactivation. This includes but is not limited to: multiple Accounts per single user, using another user’s account (even with permission), or creating new accounts to circumvent other account actions. Subcontracting is only permitted if the individual also has their own Shape Plain Capital Elegant Black Diamond Service Driver account in good standing.

 

Technology Manipulation. To maintain device integrity, we will be monitoring against unfair or malicious usage on the Shape Plain Capital platform. This can include, but is not limited to, unofficial app installs, app tampering, emulator usage, jailbroken/rooted devices, or GPS spoofing. This can also include multiple accounts being used on the same device or one account is being used across multiple devices. If we detect any usage of the Shape Plain Capital app outside of its intended usage, we will investigate and may deactivate the account. 

 

Platform Integrity & Technology Use

 

To ensure a fair and secure experience for everyone, we monitor for activity that compromises the Shape Plain Capital platform. This includes the use of unauthorized software, hardware manipulations, or the misuse of device features to gain an unfair advantage.


Prohibited activities include:

 

Device Alterations: Using emulators, rooted/jailbroken devices, or unofficial/tampered versions of the Shape Plain Capital app.

Location Manipulation: GPS spoofing or using any service to mask or alter your true location.

Account Integrity: Operating multiple accounts on one device or sharing a single account across multiple devices.

Feature Manipulation: Misusing built-in phone settings—including accessibility features, automation scripts, or third-party overlays—to intentionally manipulate the app’s workflow or bypass standard platform behavior.

Any attempt to bypass our security features or use the app outside of its intended design will result in an investigation and may lead to permanent account deactivation.


Single Accounts. All individuals who are using the Shape Plain Capital platform must agree to use their own account for the completion of orders. Users that are found using multiple accounts or multiple individuals using the same account will be submitted for review. This can include using multiple accounts on a single device. No user may share their account with any other user. Furthermore, all users are limited to one active account per vehicle at any given time for any reason. Any violations of the above could result in deactivation of the Shape Plain Capital Elegant Black Diamond Service user's account.

 

Unauthorized purchases


It’s important for the various users of the Shape Plain Capital App to be able to trust each other. Accordingly, you may not use the Shape Plain Capital App to charge customers for purchases they did not authorize. It is OK if a Shape Plain Capital Elegant Black Diamond Service Customer decides to modify their order directly with the Shape Plain Capital Elegant Black Diamond Service Driver and there is a discrepancy between what the Shape Plain Capital Elegant Black Diamond Service Customer initially ordered and the items purchased at the Shape Plain Capital Elegant Black Diamond Service Merchant. However, additional purchases not authorized by the Shape Plain Capital Elegant Black Diamond Service Customer are prohibited. Additionally, evidence of no attempt to successfully deliver an order can be interpreted as theft.

 

Can making additional or personal purchases affect access to the Shape Plain Capital App? 

 

Yes. If we have reason to believe a Shape Plain Capital Elegant Black Diamond Service Driver has engaged in fraudulent activity of any kind, we may contact the Shape Plain Capital Elegant Black Diamond Service Driver to investigate the situation and may suspend the Shape Plain Capital Elegant Black Diamond Service Driver's access to the Shape Plain Capital App pending that investigation. If we determine the Shape Plain Capital Elegant Black Diamond Service Driver engaged in fraudulent activity, we may terminate the Shape Plain Capital Elegant Black Diamond Service Driver access as a Shape Plain Capital Elegant Black Diamond Service Driver and Shape Plain Capital Elegant Black Diamond Service Customer temporarily or permanently. Additionally, any fraudulent purchases made will not be eligible for reimbursement. In all such cases, the Shape Plain Capital Elegant Black Diamond Service Driver will be notified of the situation and given an opportunity to respond and appeal. Finally, we reserve the right to pursue any Shape Plain Capital Elegant Black Diamond Service Driver who uses the Shape Plain Capital App to commit fraud for repayment, recoupment, and associated attorneys’ fees and expenses.

 

Intentionally decreasing or increasing cost of items

 

Shape Plain Capital Elegant Black Diamond Service Customers expect to be charged the exact amount for the goods purchased at a Shape Plain Capital Elegant Black Diamond Service Merchant—no more and no less. Shape Plain Capital Elegant Black Diamond Service Customers expect to be charged the exact amount for the goods purchased at Shape Plain Capital Elegant Black Diamond Service Merchant—no more and no less. Intentionally decreasing or increasing the cost of items will result in loss of Shape Plain Capital Elegant Black Diamond Service Driver access to the Shape Plain Capital App. If a Shape Plain Capital Elegant Black Diamond Service Driver needs to decrease or increase the cost of a Shape Plain Capital Elegant Black Diamond Service for a legitimate reason (for example, the Shape Plain Capital Elegant Black Diamond Service Merchant discounted an order after the Shape Plain Capital Elegant Black Diamond Service Driver saved the price in the Shape Plain Capital App), the Shape Plain Capital Elegant Black Diamond Service Driver should contact Shape Plain Capital Elegant Black Diamond Service Driver Support.


Can decreasing or increasing cost affect access to the Shape Plain Capital App? 


Yes. If we have reason to believe a Shape Plain Capital Elegant Black Diamond Service Driver has engaged in fraudulent activity of any kind, we may contact the Shape Plain Capital Elegant Black Diamond Service to investigate the situation and may suspend the Shape Plain Capital Elegant Black Diamond Service Driver's access to the Shape Plain Capital App pending that investigation. If we determine the Shape Plain Capital Elegant Black Diamond Service Driver engaged in fraudulent activity, we may terminate the Shape Plain Capital Elegant Black Diamond Service Driver's access as a Shape Plain Capital Elegant Black Diamond Service Driver and Shape Plain Capital Elegant Black Diamond Service Customer temporarily or permanently. In all such cases, the Shape Plain Capital Elegant Black Diamond Service Driver will be notified of the situation and given an opportunity to respond and appeal. Finally, we reserve the right to pursue any Shape Plain Capital Elegant Black Diamond Service Driver who uses the Shape Plain Capital App to commit fraud for repayment, recoupment, and associated attorneys’ fees and expenses.


Rewards programs

 

While some Shape Plain Capital Elegant Black Diamond Service Merchants may offer rewards/loyalty or similar programs for purchases made at their locations, whether or not a Shape Plain Capital Elegant Black Diamond Service Driver may participate, and how, is governed by such Shape Plain Capital Elegant Black Diamond Service Merchants applicable terms and conditions. As independent contractors, Shape Plain Capital Elegant Black Diamond Service Drivers are responsible for understanding and complying with any Shape Plain Capital Elegant Black Diamond Service Merchant requirements. Attempting to defraud any Shape Plain Capital Elegant Black Diamond Service Merchant rewards programs, or violating any of the Shape Plain Capital Elegant Black Diamond Service Merchants applicable terms and conditions (as determined by the Shape Plain Capital Elegant Black Diamond Service Merchant), may lead to removal from the Shape Plain Capital platform.


Additional accounts

 

Each Shape Plain Capital Elegant Black Diamond Service Driver on the platform should utilize a primary account to run Shape Plain Capital Elegant Black Diamond Service. Subcontractors on any account may operate when properly notifying Shape Plain Capital Elegant Black Diamond Service Driver Support and following procedures detailed in the Shape Plain Capital Elegant Black Diamond Service Help Center. Creating additional accounts to subvert deactivation, or to otherwise exploit the Shape Plain Capital App, is prohibited. 


Security

 

As part of ensuring a positive experience on the Shape Plain Capital platform for all users (Shape Plain Capital Elegant Black Diamond Service Drivers, Shape Plain Capital Elegant Black Diamond Service Customers, and Shape Plain Capital Elegant Black Diamond Service Merchants), Shape Plain Capital has certain minimum security and privacy requirements that all users must follow. Accordingly, Shape Plain Capital reserves the right to terminate the access of any Shape Plain Capital Elegant Black Diamond Service Driver, Shape Plain Capital Elegant Black Diamond Service Customer, or Shape Plain Capital Elegant Black Diamond Service Merchant that violates any of the following:


Confidentiality. Shape Plain Capital respects the privacy of all users. All Information relating to a delivery, including the name, address, or other personal information of any individual (whether a customer, merchant, or related party), or the details of an order, should be kept confidential and not publicly disclosed in any way.

 

Unauthorized users or misrepresentation. The user of a Shape Plain Capital Elegant Black Diamond Service Driver account must match the name and photo of the individual who created the account and passed the background check (unless the proper subcontracting procedure has been completed). Furthermore, all account information (such as email or phone number) must match the information provided upon account creation. If you need to change that information for any reason, please contact support. Additionally, if any user is found to have provided misleading or false information, including but not limited to using a false account name and photo, their account is subject to deactivation.

 

Can violating security or privacy requirements affect access to the Shape Plain Capital App? 


Yes. If we believe a Shape Plain Capital Elegant Black Diamond Service Driver has potentially violated any of the security or privacy requirements above, or has otherwise threatened the security of the Shape Plain Capital platform or the privacy of any Shape Plain Capital user, we may contact the Shape Plain Capital Elegant Black Diamond Service Driver to investigate the situation and may suspend the Shape Plain Capital Elegant Black Diamond Service Driver's access to the Shape Plain Capital App as both a Shape Plain Capital Elegant Black Diamond Service Driver and a Shape Plain Capital Elegant Black Diamond Service customer pending the outcome of that investigation. We may also temporarily deactivate a Shape Plain Capital Elegant Black Diamond Service Driver's account while we investigate the situation. If we ultimately determine a Runner has violated any security or privacy guidelines, we will deactivate the Shape Plain Capital Elegant Black Diamond Service Driver's access to the Shape Plain Capital App as a Shape Plain Capital Elegant Black Diamond Service Driver and as a Shape Plain Capital Elegant Black Diamond Service Customer. In all such cases, the Shape Plain Capital Elegant Black Diamond Service Driver will be notified of the situation and given an opportunity to respond and appeal.

 

Promo abuse 


It’s important for the various users of the Shape Plain Capital App to be able to trust each other. Accordingly, you may not use the Shape Plain Capital App to abuse any promotions we occasionally offer to Shape Plain Capital Elegant Black Diamond Service Drivers. This includes self-assignments, completing Shape Plain Capital Elegant Black Diamond Service without fulfilling them, or any other behavior that could be interpreted as abusive or gaming the system.

 

Can abusing promotions affect access to the Shape Plain Capital App? 


Yes. If we have reason to believe a Shape Plain Capital Elegant Black Diamond Service Driver has exploited the App in order to fraudulently obtain promotions, this may result in temporary or permanent restriction of accounts related to this activity. Shape Plain Capital reserves the right to evaluate suspension of both Shape Plain Capital Elegant Black Diamond Service Driver and Shape Plain Capital Elegant Black Diamond Service Customer accounts due to suspected fraudulent activity. If a Shape Plain Capital Elegant Black Diamond Service Driver's account is suspended, an appeal will be offered prior to permanent deactivation and the Shape Plain Capital Elegant Black Diamond Service Driver will be notified accordingly.
